MEDICAL,USA: 1. Person who performs a service for someone else under employment or contract for hire. A contract can be expressed or implied or oral or written. 2. Under Medicare Secondary Payer guidelines, this is defined as an individual who is working for an employer or an individual who, although not actually working for an employer, is receiving from an employer payments that are subject to Federal Insurance Contributions Act (FICA) taxes or would be subject to FICA taxes except that the employer is exempt from those taxes under the Internal Revenue Code (IRC).

UK: Anyone under a contract of service as opposed to a contract for services. The difficulty in making the distinction has led to the development of legal tests. To avoid legal disputes the insurer defines ’employee’ broadly in employers’ and public liability policies (the latter for the purpose of an exclusion). The definition extends to: labour gangs, sub-contractors, self-employed persons, persons hired or borrowed by the insured, volunteers, etc. The Employers’ Liability (Compulsory Insurance) Act definition is: ‘An individual who has entered into or works under a contract of service or apprenticeship with any employer, whether by way of manual labour, clerical work, or otherwise, whether such contract is expressed or implied, or oral or in writing.’ See EXEMPT EMPLOYEES; EMPLOYEE/EMPLOYER RELATIONSHIP.

Occupational health service program for employees, their family members, and employers to assist with personal or financial problems (e.g., family or marital issues, on-the-job stress, legal problems, child care, substance abuse).

Employee assistance programs (EAP) are provided to employees by an employer to address, treat, and prevent mental and behavioral problems, especially addictive problems. Help with family stress, relationships, and financial management may also be included. The purpose is to keep the employee well adjusted and productive. An EAP can be effective in reducing workers compensation and group health insurance costs.

Employee Retirement Income Security Act (ERISA)

Federal legislation enacted in 1974 that protects pension rights of employees, prohibits states from applying specific mandates to self-insured group health benefit plans, and shields self-insured employers from paying premium taxes, which insurance companies and managed care plans must do. Additional ERISA provisions require that health plans provide a description of the benefits of the plan, identify the persons responsible for operating the plan, explain the arrangements for funding and amending the plan, provide an explanation of benefits (EOB) when a claim is denied, and provide information on members’ rights of appeal if a claim has been denied. The Department of Labor administers the law. Also called the Pension Reform Act .
